Patel v. Gwire
Plaintiffs Rakash (Ray) Patel and the Patel Family Trust (collectively, the Patels) appeal from a summary judgment in a legal malpractice suit against their former attorney, defendant William Gwire. The Patels contend they presented sufficient evidence to raise a triable issue of fact about whether Gwire negligently failed to introduce critical evidence in an underlying arbitration and whether that failure caused the Patels to suffer a less favorable result than they otherwise would have obtained. We agree the evidence was sufficient to raise a triable issue on both disputed elements. We reverse.
